利用者の激しい反発を受け、facebookは二月４日に発表した新しい利用規約を一旦撤回し、これからユーザと話し合いを持ちながら、改めて利用規約の見直しを行うと発表した。facebookユーザの反対運動は、米国のFTCに対してクレームと調査依頼のレポートを提出する直前にまで展開していたが、レポート提出が予定されていた前日の夜10時に、レポートを用意していたプライバシー保護団体の担当者の自宅にfacebookのエグゼクティブの一人が訪れ、利用規約は撤回する予定なのでレポートの提出を待ってほしいと頼んだという。
以下が問題となっている利用規約の部分

By posting User Content to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose, commercial, advertising, or otherwise, on or in connection with the Site or the promotion thereof. “… You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content.
